Recently, some non-tenured union members have expressed concern that showing their union affiliation and supporting the union might jeopardize their continued employment with Madison CUSD 12. Obviously, with the recent dismissal of non-tenured teachers, this concern is understood. However, Local 763 would like to emphasize that steps are currently being taken to address these recent events and also take a moment to explain the law in regards to non-tenured teachers and union membership.
Union members must be aware that no harm can come to a union member, whether they are tenured or non-tenured, for participation and support of union activities. All members are under the protection of the Illinois Educational Labor Relations Act. This act allows for all members to fully participate in the collective bargaining agreements. Concerted efforts on the part of a union in the State of Illinois are protected under Section 13 of the Employee Rights of the Illinois Educational Labor Relations Act. This law further states that any school district that fails to renew non-tenured teachers or attempts to dismiss tenured teachers is conducting severe violations of Unfair Labor Practice Laws (section 14 of the Unfair Labor Practices). Consequently, non-tenured teachers are not at any greater risk of termination because of participating in union activities.
Additionally, as employees of an Accelerated School District, we are directed to be collaborative and communicative with all members of the Madison CUSD 12 community. Open communication, collaboration, and respect are a part of the Accelerated School philosophy. It is to be noted that the district leadership has subscribed to this philosophy of thought and is bound - and will be held - to the principals set forth in the Accelerated Schools Program.
We stress once again that the AFT and your Local 763 are aggressively addressing events that have recently taken place in the district that might be prompting some members to have concerns about union involvement.
